My younger sister was in a car accident about 5 years ago. It was night, heavy rain and and she was attempting to make a left hand turn. She hit a car head on. It was her fault. I know that all parties in the crash make seem to be okay right after the crash and they all got out and walked away from the accident. The next day, the one 20 something male passenger, went to the hospital and went ahead with suing our insurance. My sister who weighs all of 130lbs left the accident with not a bruise on her, she never sustained any injuries and it was head on. Shouldn’t the injuries be similar?
Well five years later we get a call today from a lawyer telling us that the $100,000 he was to receive from the insurance is not enough and he will be going after all our assets. He did go ahead and get back surgery, though we did here he had previous back problems before all of this.
I cannot help but feel like this blue collar GM worker, a young man in his twenties has sustained such injuries that he needs over $100,000 and go after our home and business.I feel once he found out that my family is well off, he has been trying to get “everything” out of us. What should we do? My father is a chiropractor who has built this family business from nothing and now we feel like we are about to loose it all.
My family is being threatened to loose our house and our business due to a auto accident! what should we do?

get to a lawyer…im not sure if 5 years later they can come back to you for more money…but you need GOOD legal advice…i wouldnt worry too much until you talk to an attorney and i’d do that ASAP
You need a lawyer. There is not enough information here to say what the plaintiff can or cannot take, or if he signed anything when he received the settlement, or if it was a pre-existing condition, or what.
If the judgment goes against you, yes, they can take your house and other assets. That is why you need a lawyer.
first and foremost call the insurance company that is why you pay insurance.
Okay first of all – you’re a snob, and I find your personification of victim as being nothing more than a blue collar “GM worker” to be offensive and rude.
Secondly, no the injuries shouldn’t be “similar”. Just because your sister didn’t get hurt doesn’t mean that someone in the other car couldn’t have been hurt severely or even killed.
Get a lawyer – after all you are so “well off” people want to take everything…especially some lowly factory worker your sister plowed into head on that you should be able to afford one.
Five years is a long time between accident and lawsuit. So you may have something there. Maybe you will get lucky and the person who’s back is likely permanent damaged might have to just take what he gets from your insurance company. (Because we all know – that man was “just” a GM Factory worker so it’s not like he matters.)
This happens all the time and the plaintiff usually wins — He is still suffering from the damage your sister caused. I don’t mean to cast aspersions here, but this is what happens with only $100,000 in coverage. A million dollars is standard. Some pennies aren’t worth pinching and this is why.

The injuries needn’t be similar and are rarely even comparable. In enormous wrecks, when both parties are basically unrecognizable, then you can draw parallels. That your sister walked away has absolutely no bearing on what’s going on with him.
GM employees are well paid, “blue collar” or not. If your sister caused him to be unable to earn his full living, then it’s on her to not only replace that income but also cover any kind of physical therapy, ongoing medical expenses, etc.
If you have so many doubts about this guy and you feel like spending some money, hire a P.I. and a lawyer.
